General terms and conditions

Article 1 Applicability

When you buy a product through growyourberries.com, only these general terms and conditions apply. Any general terms and conditions used by you do not apply.

Article 2 formation of purchase agreement

2.1. The purchase agreement is concluded by clicking on the relevant product on the purchase page of www.growyourberries.com.

2.2. The purchase agreement concluded by you will be archived. You can access the agreement by contacting growyourberries.com.

2.3. When the purchase agreement is concluded, you will receive a confirmation of the concluded purchase agreement by e-mail. We advise you to print this confirmation or save it permanently.

Article 3 payment of price and delivery

3.1. The price for the product must be paid in full before the ordered product is sent to the person identified by you by Growyourberries.com. You can pay by the methods indicated on the website. If you pay by bank transfer, you must transfer the money immediately after the conclusion of the agreement in order to enable timely shipment.

3.2. The price of the chosen product corresponds to the price indicated on the purchase page of www.growyourberries.com.

3.3. Once payment is received by Growyourberries.com, the product will be dispatched. Delivery of the product you have purchased will be made to the address you have provided. Delivery of the product will generally take place on time. However, Growyourberries.com accepts no liability for any late delivery. Any urgent shipments can be agreed upon, any additional costs that may be involved will be charged.

3.4. If the product in question is no longer available, Growyourberries.com shall inform you immediately in order to find a suitable solution in consultation.

Article 4 main characteristics trees

4.1. The shrub to be bought by you will when packed for shipment be in a good condition, as you buy it at a garden centre.

4.2. The shrub will be packed for shipment in packaging specially designed for shipping plants/trees. This will keep the shrub in good to reasonable condition during shipment. After unpacking, the shrub should be planted as soon as possible. For planting instructions, see the website www.growyourberries.com.

4.3. Growyourberries.com accepts no liability in respect of the shrub other than the obligations arising from these general conditions. Any liability shall never exceed the price of the shrub paid by you.

Article 5 dissolution of agreement

5.1. After you have concluded this agreement you cannot dissolve this agreement. Unless the shrub does not meet the provisions of article 3 of these general terms and conditions or have not been delivered and this is due to growyourberries.com or the delivering party. For a dissolution you should contact growyourberries.com. For this purpose you should send the relevant shrub - as far as possible - as well as a written explanation - explaining your complaints - to growyourberries.com. Growyourberries.com will then notify you further as soon as possible.

5.2. The right of withdrawal described in Article 7:46D of the Dutch Civil Code does not apply because the purchase agreement refers to products that can age quickly and are clearly personal in nature.

Article 6 privacy

Since 25 May 2018, the General Data Protection Regulation (AVG) applies. This means that the same privacy legislation applies throughout the European Union (EU). Growyourberries.com will only use your email and address details for the newsletter. Growyourberries.com will pass on your details to the parcel service regarding the delivery of your order. The parcel service and the web builder have agreed not to use customer data for their own purposes. If you have indicated that you do not wish to receive information from us about trees or other similar matters, growyourberries.com will remove your details from its files. This can be done after you have received a newsletter. You can unsubscribe at the bottom of the newsletter.

Article 7 waiver of rights

Growyourberries.com may, for reasons of efficiency, decide not to exercise certain rights arising from these general terms and conditions. After all, such a decision will only apply as a waiver in that particular case. Growyourberries.com may, in another similar case, decide to exercise its rights under these general conditions.

Article 8 deviations

For any deviations from these general conditions and the prices used, please contact Growyourberries.com. These deviations are only valid insofar as they are recorded in writing and signed by Growyourberries.com

Article 9 Home shopping code of conduct and general terms and conditions

Growyourberries.com subscribes to the Home Shopping Guarantee Code of Conduct for the benefit of consumers. Deviations in these general terms and conditions from the General Home Shopping Conditions are deemed necessary given the nature of the product.
